General terms and conditions of sale
Preamble
The following general conditions of sale govern all the transactions established on the web catalog of SOLEIL D’ARGAN. Any order placed on this site supposes of the customer his unconditional and irrevocable acceptance of these conditions.
The company ATELIA SARL commercializes the articles on line SOLEIL D’ARGAN.
Anxious to always better answer the expectations of its customers, the company ATELIA SARL wished to set up a network of remote sale by telephone and by electronic way (Internet) of some of its products.
The list of the articles SOLEIL D’ARGAN proposed within the framework of the remote sale is consultable on the Internet site www.soleildargan.ma
The system thus set up, which supposes an active step on behalf of the customer, is in all points in conformity with the requirements required as regards remote sale and, in particular, by the articles L. 111-1, L.113-3 and L. 121-18 and following ones of the Code of the consumption.
It is specified that the company ATELIA limited liability company does not carry out any telephone canvassing of its customers or prospects, and that consequently the provisions of the Code of consumption applicable to the telephone canvassing at residence, in particular articles L. 121-21 and following and L. 121-27 of the Code of consumption, are inapplicable to the transactions falling under the present general conditions of sale.
The use of the process of remote sale described in the present general conditions of sale is reserved to the only consumers, with the direction that the law and the jurisprudence give, acting exclusively for their own account.
Article 1: Scope of application
The present contract is a remote contract which has for object to define the rights and obligations of the parts within the framework of the sale of the products of the company ATELIA limited liability company, on Internet, by the intermediary of the platform e-commerce.
The present general conditions of sale are applicable to all the sales of articles ATELIA limited liability company concluded either via the intermediary of the Customer relation service set up by the company ATELIA limited liability company, or via the accessible commercial site of Internet www.soleildargan.ma, with a view to a delivery in the rest of the World.
1.1 – As regards the sale by telephone, any sale of articles SOLEIL D’ARGAN through the intermediary of the Customer Relation Service set up by the company ATELIA SARL is concluded under the resolutory condition of the acceptance of the present general conditions of sale by the customer.
1.2 – As regards the sale by electronic way (Internet), the customer declares to have taken knowledge of the present general conditions of sale before the placing of his order. The validation of his order is therefore acceptance without restriction or reservation of these general conditions of sale.
In accordance with the provisions of the article 1369-1 of the Civil code, the present general conditions of sale can be preserved by any person visiting the Internet site www.soleildargan.ma, by the means of a data-processing recording and can moreover be reproduced by the customer, by the means of their impression; the present general conditions of sale will be applicable as long as they will appear on the Internet site www.soleildargan.ma. In the hypothesis where, after the date of their suppression of Internet site www.soleildargan.ma, the present general conditions of sale would remain nevertheless accessible to the public via other Internet sites or by any other means, they would not be however any more opposable to the company ATELIA limited liability company

Article 3: Information relating to the articles
The information relative to all the articles SOLEIL D’ARGAN likely to be sold through the intermediary of the Customer Relation Service of the company ATELIA SARL are available, with their references on the Internet site www.soleildargan.ma
These information are in conformity with the requirements required by the legal and statutory texts in force and, in particular, by the articles L. 111-1 and L.113-3 of the Code of the consumption and by the ministerial decree of December 3, 1987 relating to the information of the consumer on the prices.
Article 4 : Orders of the articles
4.1 Orders by telephone
The orders will be received, in French, in English or in Arabic, by the Customer relation department of the company ATELIA SARL (from Monday till Saturday, from 9:00 am till 5:00 pm, except public holidays.
4.2 Orders by Internet
Orders may also be placed via the Internet on the merchant site www.soleildargan.ma. The customer shall bear the telecommunication costs of accessing the Internet and using the website www.lessensdemarrakech.ma.
Photographs, graphics and descriptions of the products proposed with the sale are only indicative and do not engage the company ATELIA limited liability company. The customers have the possibility of obtaining additional information by contacting by telephone the Customer relation department of the company ATELIA limited liability company.
In the event of obvious error between the characteristics of the articles and their representation, the company ATELIA limited liability company could not see its committed responsibility.
The customer will have, to be able to buy a product at the time of his first order, to open a customer account and to fill a form of order specifying certain obligatory fields so that its selection can be taken into account by company ATELIA limited liability company.
In the event of prolonged inactivity at the time of the connection it is possible that the selection of the articles chosen before this inactivity is not any more guaranteed. The customer will be invited to take again his selection of products since the departure.
All the steps necessary for the sale will be specified on the website www.soleildargan.ma in accordance with the provisions of Article 1369-1 of the Civil Code.
In application of the provisions of article 1369-2 of the Civil Code, the customer will have the possibility, before definitively validating his order, to check the details of his order and its total price, and to correct possible errors, before confirming it to express his acceptance. From the moment when the customer validated his order, the company ATELIA limited liability company will acknowledge receipt of this one without delay and by electronic way.
However, the sale will be regarded as final only after the sending to the customer of the confirmation of the order by company ATELIA limited liability company, specifying the forwarding of the articles. Only the dispatched articles will be debited with the transport charges.
4.3 Refusal of the orders
In accordance with the provisions of the L.122 1 article of the Code of consumption, ATELIA limited liability company will be entitled to refuse any abnormal order or placed in bad faith.
Moreover, the company ATELIA limited liability company will be entitled to refuse any order of a customer with whom would exist a litigation relating to the payment of a former order.
4.4 Cancellation, modification of order
If the user wishes to postpone or cancel his delivery, he will have to contact directly by e-mail ATELIA limited liability company at least 48 (forty-eight) hours before the planned sending of his order, Sunday not included.
In the case where the postponement or the cancellation is requested less than 48 (forty-eight) working hours before the hour envisaged at the time of its order, the acceptance of this postponement or cancellation remains with the discretion of ATELIA limited liability company, what the User understands and accepts. The worked hours mean the usual opening days, except exceptional closings of the establishment, what the User understands and accepts.
Article 5 : Price of the articles
The price of the articles is in MAD (MOROCCAN DIRHAM) and is understood to be all inclusive of tax, plus delivery charges.
In accordance with the provisions of article L.121 19 of the Code of consumption, the customer will receive, at the time of the delivery, for each of the articles, the written confirmation of the price paid detailing the price of the articles and the expenses of delivery put at his charge.
Article 6 : Payment
The fact of validating your order implies for you the obligation to pay the price indicated.
The payment of your purchases is made by credit card through the secure system of the CMI payment link.
The card is only debited when the order is shipped. In case of split deliveries, only the products shipped are debited.
Article 7: Delivery
A- The products are delivered to the address indicated by the customer via the order form. The shipping costs will be communicated after the validation of the order, depending on the weight of the package and its destination.
B- The customer must verify the completeness and compliance of the information he provides. The latter cannot be held responsible for any input errors and consequences in terms of delay or error of delivery. In this context, all the expenses engaged for the forwarding of the order will be entirely with the load of the customer.
C- ATELIA limited liability company could not be held for person in charge of delays of delivery because of errors or disturbances ascribable to the carriers (total or partial strike in particular of the postal services and means of transport and/or communications).the customer is held to check the state of the packing of the goods to the delivery and to announce the damage due to the carrier within 48 hours as from the date of reception of the parcel.
D- An e-mail is sent to the customer to inform him of the departure of his parcel.
E- In case of delay in delivery of more than three days compared to the date we indicated in the shipping email, we suggest to check with the transport company that the package is not pending. We will then contact the shipping company to start an investigation. An investigation can last up to 21 working days from the date of its opening. If the product is found during this time, it will be sent back to your home immediately. If, on the other hand, the product is not found at the end of the 21 working day investigation period, the transport company considers the package to be lost. It is only after this period that we can send you a replacement product. If the product(s) ordered were no longer available at that time, we would reimburse you the amount of the products concerned by the loss of the carrier.
Article 8 : Intellectual property rights
The brand SOLEIL D’ARGAN, as well as the whole of the figurative brands or not and more generally all the other brands, illustrations, images and logotypes appearing on the articles SOLEIL D’ARGAN, their accessories or their packagings, that they are deposited or not, are and will remain the exclusive property of the company ATELIA SARL.
Any total or partial reproduction, modification or use of these marks, illustrations, images and logotypes, for some motive and on some support that it is, without express and preliminary agreement of the company ATELIA SARL, is strictly forbidden. It is the same of any combination or conjunction with any other mark, symbol, logotype and more generally any distinctive sign intended to form a composite logo. It will be the same for all royalties, drawings and models, patents which are the property of company ATELIA limited liability company.
Article 9: Proof of transactions paid by bank card
The data recorded by the CMI on the platform of payment Multi-channel for the account of SOLEIL D’ARGAN constitute the proof of the whole of the commercial transactions passed between you and the company ATELIA limited liability company.
Article 10: Litigations – applicable law
The present general conditions of sale are subjected to the Moroccan right. In case of difficulty arising at the time of the order or the delivery of the articles SOLEIL D’ARGAN, the customer will have the possibility, before any action in justice, to look for an amicable solution, notably with the help of an association of consumers or any other council of his choice. Any dispute likely to result from the interpretation or from the execution of the present general conditions of sale and its consequences will be subjected to the exclusive competence of the Moroccan commercial courts.
